§1 General Provisions
1.1. These Terms of Service govern the use of the CheaperForDrug online platform available at www.taniejpolek.pl and mobile applications (hereinafter: "Platform" or "Service").
1.2. The administrator and owner of the Platform is WEBET SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered at ul. 1 Maja 30A, 45-355 Opole, Poland, entered in the National Court Register under KRS number 0000940072, NIP 7543346806, REGON 520717497 (hereinafter: "Administrator" or "Service Provider").
1.3. Use of the Platform constitutes acceptance of these Terms of Service. If you do not agree with the terms, please stop using the Platform.
1.4. These Terms of Service are available free of charge on the Service website in a form that allows downloading, saving and printing.
1.5. The terms of use of the Platform may also be defined by separate regulations for specific services, which supplement these Terms of Service.
1.6. Only persons who have reached the age of 18 may use the Service. By creating an Account, sending an Inquiry or buying a Paid Subscription, the User confirms that they have reached the age of 18.
§2 Definitions
2.1. Platform/Service — the TaniejPoLek web and mobile application used to compare prices of non-prescription medicines and dietary supplements in online pharmacies and to send Inquiries to Brick-and-mortar Pharmacies nearby.
2.2. User — any natural person, legal entity or organisational unit without legal personality that uses the Platform.
2.3. Consumer — a natural person performing a legal act not directly related to their business or professional activity (within the meaning of EU consumer law, including Directive 2011/83/EU).
2.4. Account — the User's individual profile in the Service, protected by login credentials (email address) and password.
2.5. Free Subscription — free access to the Service's limited functionality in accordance with §6.1.
2.6. Paid Subscription — paid access to full Service functionalities, available as:
- Annual subscription ZAR 249 — unlimited access to all features for 12 months, renewing automatically every 12 months until the renewal is cancelled
2.7. Shopping List — a collection of medicines selected by the User to compare prices and find the cheapest purchase option.
2.8. Brick-and-mortar Pharmacy — a community pharmacy in Poland that has concluded with the Administrator an agreement on handling Inquiries.
2.9. Inquiry — a list of products with quantities sent by the User, which the Administrator passes to Brick-and-mortar Pharmacies nearby with a request for information on availability and price.
2.10. Pickup Code — a code consisting of "TPL-" and four characters, which the User receives after reserving a pickup and gives at the Brick-and-mortar Pharmacy.
§3 Service Description
3.1. CheaperForDrug is an independent platform that compares the prices of over-the-counter medicines in online pharmacies. The Platform also allows you to send an Inquiry to Brick-and-mortar Pharmacies nearby and to collect an order against a Pickup Code (§ 8).
3.2. The Platform offers:
- Comparison of entire shopping list (basket) prices rather than individual medicines
- Finding the cheapest purchase options for the whole medicine list
- Price and availability information for medicines in online pharmacies
- Purchase optimisation through recommendations to split orders between pharmacies
- Search history and saved shopping lists
3.3. Important information:
- CheaperForDrug is NOT a pharmacy and does not sell medicines
- The Platform does not receive commission from pharmacies for displaying their offers
- Brick-and-mortar Pharmacies may pay the Platform a fixed fee for handling Inquiries, independent of the number of Inquiries and of sales
- We are an independent comparison tool
- We do not direct Users to specific pharmacies in exchange for remuneration
- The order in which Brick-and-mortar Pharmacies receive the Inquiry depends solely on distance from the User and is never paid for
- All pharmacies are treated equally in the search results
3.4. The Platform allows the User to navigate to the chosen online pharmacy to complete a purchase; however the Administrator does not participate in the sale transaction and bears no responsibility for it. The same applies to a purchase at a Brick-and-mortar Pharmacy after an Inquiry (§ 8).
§4 Technical requirements
For the proper use of the Service the following technical requirements must be met:
- 4.1. A device with internet access at a bandwidth of at least 1 Mbps.
- 4.2. An up-to-date version of a web browser that supports HTML5, JavaScript and cookies - in particular Chrome (version 110 or newer), Firefox (version 115 or newer), Safari (version 16 or newer), Microsoft Edge (version 110 or newer).
- 4.3. Cookies and local storage enabled in the browser.
- 4.4. An active email address - to create an Account, receive transactional notifications and communicate with the Administrator.
- 4.5. For the full basket-comparison functionality - JavaScript enabled on the browser side.
4.6. The Administrator endeavours to ensure that the Service operates on all common devices (desktops, laptops, smartphones, tablets) and at screen resolutions from 320 px upwards. The Administrator is not liable for unavailability or malfunction of the Service caused by the use of unsupported browsers or operating systems, or by a non-recommended technical configuration.
§5 Registration and User Account
5.1. Use of the basic functionalities of the Service (free version) requires creating an Account through registration.
5.2. Account creation is voluntary and free of charge.
5.3. To create an Account the following are required: (a) provision of a current email address; (b) creation of a secure password; (c) acceptance of these Terms of Service and the Privacy Policy. Optionally the User may provide first and last name.
5.4. A User may have only one Account in the Service. Creating multiple Accounts by one person is not allowed.
5.5. The User undertakes to: (a) provide truthful and current data at registration; (b) keep login credentials (email and password) confidential; (c) promptly notify the Administrator of unauthorised access to the Account; (d) not share the Account with third parties.
5.6. The Administrator reserves the right to refuse registration or suspend an Account in case of breach of the Terms, suspicion of fraud or other justified reasons (details in §20 of these Terms).
5.7. The User may delete their Account at any time through the settings panel or by contacting the Administrator at biuro@webet.pl. Account deletion will result in the permanent removal of personal data, except data legally required to be retained (details in the Privacy Policy).
5.8. The Paid Subscription can be purchased without creating an Account first. In that case, once the order is paid, we create the Account automatically for the email address given at payment (if an Account with that address already exists, the Subscription is assigned to it) and send the first-login details to that address; the User sets their own password at the first login. An Account is required to use the Paid Subscription and to manage its renewal.
5.9. An Inquiry to pharmacies nearby can be sent without first creating an Account. The Administrator then creates an Account without a password for the e-mail address given, and by sending the Inquiry the User accepts the Terms and the Privacy Policy (section 8.15).
§6 Subscription Plans and Payments
6.1. Free Subscription:
- Drug search across online pharmacies
- Creation of a health profile (shopping list) and saving one basket in the Account
- Unlimited basket price comparisons — we always show the cheapest pharmacy
- Calculating how long a product's supply lasts at a given dose (‘Supply & price’)
- Medicine Cabinet AI — 2 answers in total (§7) and an aggregate summary of the weekly price drops (‘What got cheaper’), without product names and prices
- 3 Inquiries to pharmacies nearby per calendar month (§ 8)
6.2. Paid Subscription:
Annual subscription ZAR 249:
- Price: ZAR 249 for each 12-month period (a promotional code reduces only the price of the first period)
- Unlimited access to the cheapest options for all shopping lists
- Search history and savings statistics
- Priority technical support
- Renews automatically every 12 months — the renewal can be cancelled at any time in the Account, and access continues until the end of the paid period
- Basket substitutes — a cheaper equivalent for an item in the basket, shown with its price (no medical advice)
- ‘Supply & price’ details for the products in the basket — the lowest, usual and highest price of the last 90 days plus an email reminder before the supply runs out; a chart of the basket price over the last 12 months and an alert when the basket's price dips
- The full ‘What got cheaper’ list — weekly price drops with product names and prices — and a weekly email with that list (can be switched off in the Account)
- Saved baskets without a limit
- Medicine Cabinet AI — 50 questions in each Subscription year and the option to buy question packs (§7)
- Inquiries to pharmacies nearby with no monthly limit; the Inquiry goes straight to the two nearest pharmacies (§ 8)
6.3. Payments are processed through the secure Stripe payment system (Stripe Payments Europe Ltd., based in Ireland). The annual subscription can be paid with payment methods that support recurring payments, as shown in the payment form (in particular a payment card). By purchasing the Subscription, the User authorises the Administrator to collect, through Stripe, the fee for each subsequent renewal from that payment method until the renewal is cancelled. Payment method details are stored by Stripe only; the payment method can be changed in the Account (My account → Plan & referrals).
6.4. All prices are stated in South African rand (ZAR) and include VAT.
6.5. After every payment — at purchase and at each renewal — the User receives a confirmation by email and a VAT invoice (within 7 working days).
6.6. The annual subscription renews automatically every 12 months until the renewal is cancelled. At each renewal we charge the regular price in force on the renewal date — currently ZAR 249; a promotional code reduces only the price of the first period. At least 7 days before each renewal we send the User an email with the renewal date, the amount to be charged and how to cancel the renewal. The renewal can be cancelled at any time in the Account (My account → Plan & referrals → "Cancel renewal") or by email to biuro@webet.pl; cancellation does not affect access to premium features until the end of the paid period. Until the end of the paid period the renewal can be resumed in the same place ("Resume renewal"). If the renewal payment fails, we notify the User by email and premium features end at the end of the paid period, with no grace period. The payment operator may retry the payment for no longer than 14 days from the renewal date; if the payment is collected within that time, the Subscription resumes for a new 12-month period counted from the renewal date, and if not, the Subscription ends with no further charges. Annual subscriptions bought as a one-time payment before version v3.3 of these Terms entered into force do not renew automatically — they end at the end of the paid period unless the User buys the automatically renewing Subscription.
6.7. The Administrator may change the regular price of the annual Subscription only for valid reasons: a change in the VAT rate or other public levies, an increase in the cost of providing the service (in particular payment operator, infrastructure or data provider fees), or an extension of the premium features. A price change does not apply to the current, paid period — it applies from the next renewal at the earliest. We notify the User of the new price by email at least 30 days before the renewal it concerns. A User who does not accept the new price may cancel the renewal free of charge before the renewal date; the Subscription then ends at the end of the paid period.
6.8. Users covered by German or Austrian law (the Germany and Austria markets) have additional cancellation rights for the Paid Subscription after the first renewal, described in the German-language version of these Terms (Allgemeine Geschäftsbedingungen) used on the German and Austrian sites.
6.9. The German and Austrian sites carry a permanent “Verträge hier kündigen” link that lets a subscriber cancel the Paid Subscription without logging in, under § 312k of the German Civil Code (BGB); that path is described in the German-language version of these Terms.
6.10. Under the referral programme, a User who invites a friend with their referral code or link receives 30 days of Paid Subscription for every confirmed referral, and the referrer's reward is granted no more than 12 times in any rolling 12-month period. An invited friend whose referral is confirmed always receives 30 days of Paid Subscription, even if the referrer has already reached that limit. A referral is confirmed when the invited person creates an Account and confirms their email address within 7 days of using the referral code.
§7 Medicine Cabinet AI — limits and question packs
7.1. Medicine Cabinet AI answers the User's questions about products within a question allowance: Guest (a User without an Account) — can type a question, but an Account is needed to send it; after logging in or creating an Account, the typed question is sent automatically; Free Account — 2 questions in total, with no reset, counting questions used before version v3.5 of the Terms took effect; Paid Subscription — 50 questions per Subscription year, renewed at each renewal. Only a question that Medicine Cabinet AI has answered counts towards the allowance. A question that the Service did not handle (for example, outside the scope of Medicine Cabinet AI) or that was not answered because of a technical error is not counted.
7.2. Once the yearly allowance of 50 questions is used, an active Paid Subscription User can buy a pack of 100 extra questions for ZAR 49 (VAT included). The pack is available only to active Paid Subscription Users (including a Subscription granted free of charge).
7.3. Payment for the pack is one-time and does not renew automatically. Pack questions are valid for 12 months from the purchase date and can be used only while the User has an active Paid Subscription. If the Paid Subscription ends, unused pack questions remain in the Account until they expire and can be used again once the Paid Subscription is resumed within that period. If the Paid Subscription ends before the pack expires, the User may request a refund of the price for the unused pack questions, in proportion to their number, by writing to biuro@webet.pl during the pack's validity period.
7.4. Order of use: the yearly allowance of the Paid Subscription is used first; only once it is exhausted do pack questions get used, starting with the pack closest to expiry.
7.5. By ordering a question pack, the User expressly requests immediate access to the purchased questions before the 14-day withdrawal period expires, and acknowledges that the right of withdrawal is lost for questions already used. A refund on withdrawal or complaint covers only the unused part of the pack.
7.6. Payments for the pack are processed by Stripe on the terms described in point 6.3; the User receives a purchase confirmation by email.
7.7. Medicine Cabinet AI is a shopping assistant based on an artificial intelligence model: it looks up the products the User names, builds a shopping list and compares the basket price. It does not give medical or pharmaceutical advice, and its answers may contain errors. The rules for processing messages are described in point 5.7 of the Privacy Policy.
§8 Inquiry to pharmacies nearby and pickup with a code
8.1. The User may send an Inquiry to Brick-and-mortar Pharmacies nearby to check whether they have the products from their basket and how much they will pay for them, and then collect them at a Brick-and-mortar Pharmacy. The service is free of charge and operates in Poland, in every town where at least one Brick-and-mortar Pharmacy accepts Inquiries.
8.2. A person who has reached the age of 18 may send an Inquiry to pharmacies.
8.3. The Inquiry covers the products from the basket (non-prescription medicines and dietary supplements) with quantities. The User may add prescription medicines by giving their names, quantity and, if known, the payment level from the prescription. The User gives the town and chooses the range: their own town or 5, 10 or 20 km. The User may share the device's location, give a mobile phone number and add a comment for the pharmacy (up to 200 characters). The phone number and the comment are optional.
8.4. An Inquiry to pharmacies nearby requires the User's explicit consent to passing the data from the Inquiry to them. The Administrator asks for it with every Inquiry. Without consent the Administrator does not send the Inquiry. Prescription medicines reach Brick-and-mortar Pharmacies only if the User ticks the consent next to the prescription medicines; without it the Inquiry covers only non-prescription products, and a basket consisting only of prescription medicines cannot be sent.
8.5. The User withdraws the consent by cancelling the Inquiry. Brick-and-mortar Pharmacies that have not answered then lose access to the User's data in their panel immediately; a Brick-and-mortar Pharmacy that has already answered loses the phone number immediately and the remaining data after 24 hours. The scope of the data a Brick-and-mortar Pharmacy sees, and the periods for which it is kept, are described in section 5.8 of the Privacy Policy.
8.6. The Inquiry goes to Brick-and-mortar Pharmacies one after another by distance from the location given by the User. Brick-and-mortar Pharmacies may pay the Administrator a fixed fee for handling Inquiries; the fee does not affect which pharmacy receives the Inquiry or in what order. Only pharmacies that are open at the time of the Inquiry receive it. The nearest receives it first, the next after about 10 minutes, until one answers. The Inquiry of a User with an active Paid Subscription goes straight to the two nearest Brick-and-mortar Pharmacies. A repeated Inquiry after pickup goes first to the pharmacy where the User collected the previous order, if it is within range and open. The Administrator does not recommend any pharmacy and does not keep a ranking of Brick-and-mortar Pharmacies.
8.7. The User receives the answer of the Brick-and-mortar Pharmacy that answered first: whether each item is available and in what quantity, any substitute, and the price. With the answer the User learns the name, address, phone number and opening hours of that pharmacy and its information on data processing. The answer arrives by e-mail and is visible in the Service. A logged-in User may hold a text conversation with the pharmacy about the Inquiry.
8.8. By sending the Inquiry, the User asks the pharmacy for information on the availability and price of each item, including a prescription medicine. The price of a prescription medicine is indicative: the pharmacy sets the final payment when it fills the prescription. The Administrator does not publish or compare prices of prescription medicines. The pharmacy dispenses a prescription medicine only on its premises, on a valid prescription; the Inquiry and the Pickup Code do not replace a prescription.
8.9. The price of the non-prescription part given in the answer applies until the end of the pickup window, unless the pharmacy marked it as requiring confirmation at pickup or the price is an obvious mistake.
8.10. After receiving the answer the User may:
- a) reserve a pickup;
- b) ask another pharmacy, at most twice for one Inquiry; the previous answer then ceases to apply;
- c) cancel the Inquiry.
8.11. When the User reserves a pickup, the User receives a Pickup Code in the Service and by e-mail. The reservation is valid for 4 hours. After that time the Pickup Code expires. The User gives the Pickup Code at the Brick-and-mortar Pharmacy that answered. The reservation does not oblige the User to buy.
8.12. The Administrator is not a pharmacy and does not sell medicines. It passes the User's Inquiry to Brick-and-mortar Pharmacies and the pharmacy's answer to the User. Availability, price and pickup conditions are given by the pharmacy, which is responsible for them; the User concludes the sales contract with the pharmacy, at its premises, and pays there. The Administrator is responsible for passing the Inquiry and the answer correctly and for protecting the User's data.
8.13. The Administrator does not guarantee that any pharmacy will answer. If none answers within 60 minutes, or if all pharmacies in range have received the Inquiry earlier and none answers, the Inquiry expires and does not reduce the User's monthly limit. If at the time of sending all pharmacies in range are closed, the Inquiry is not sent and the Service gives the nearest opening time.
8.14. Limits:
- a) the User may have one ongoing Inquiry at a time;
- b) in the Free Subscription the User may send 3 Inquiries per calendar month; an Inquiry that expired without any answer, or one in which the pharmacy answered that it has none of the products, does not count towards the limit; an Inquiry cancelled by the User counts towards the limit;
- c) in the Paid Subscription the monthly limit does not apply.
8.15. By sending an Inquiry without logging in, the User creates an Account for the e-mail address given and accepts the Terms and the Privacy Policy. The Administrator sends the login link and the pharmacy's answer to that address. The Administrator may temporarily limit the acceptance of Inquiries without logging in.
8.16. After collecting the order the User may repeat the same Inquiry. About 25 days after pickup the Administrator may remind the User of this by e-mail; reminders can be switched off in the Account.
8.17. The pharmacy's answer is not medical or pharmaceutical advice given by the Administrator. The User discusses the choice and use of a medicine, including a substitute, with the pharmacist at the pharmacy.
§9 Refund Policy and Right of Withdrawal
9.1. 30-day money-back guarantee:
- If you are not satisfied with the service, we will refund your money without asking
- The guarantee applies for 30 days from the date of each payment for the annual Subscription — the purchase or an automatic renewal
- Applies to the paid annual subscription (ZAR 249)
- To request a refund, contact us at: biuro@webet.pl
- Refunds are made without undue delay and no later than 14 days after receiving the request, to the account/card used to make the payment
- A refund ends the Paid Subscription on the refund date and switches off its automatic renewal; the Account remains active on the Free Subscription
9.2. Right of withdrawal for Consumers (14 days):
In accordance with EU consumer law (Directive 2011/83/EU), the Consumer has the right to withdraw from a distance contract within 14 days of the conclusion of the contract (the date of payment) without giving any reason.
- Withdrawal is effected by sending an unambiguous statement to: biuro@webet.pl
- To meet the deadline, it is sufficient to send the statement before the 14-day period expires
- The model withdrawal form is Annex 1 to these Terms and is available for download as a PDF at /odstapienie-od-umowy.pdf
- In the event of withdrawal we will refund all payments received without undue delay, no later than within 14 days of receiving the statement
- Withdrawal from the contract ends the Paid Subscription and switches off its automatic renewal
9.3. By ordering the Paid Subscription, the Consumer expressly requests that the service start before the 14-day withdrawal period expires. This does not take away the Consumer's right to withdraw within that period — if the Consumer withdraws, we refund the full amount paid, with no deduction for the time the service was used.
9.4. Refunds are made using the same means of payment that the Consumer used, unless the Consumer has expressly agreed to a different method of refund that does not entail any costs for them.
§10 Basket sharing links (Short-Links /c/<32hex>)
The Service allows the User to generate a short link in the format taniejpolek.pl/c/<32-character hexadecimal string> leading to a saved basket comparison. This link acts as an access credential (capability URL) — anyone who knows the link gains read-only access to that specific basket, with no login required.
- 10.1. The link identifier is a random 32-character hexadecimal string generated cryptographically on the Administrator's side; it does not contain any User personal data.
- 10.2. Possession of the link is the only access condition (link = credential): the Service does not verify who opens the link. The User should share it only with trusted recipients and via channels they consider secure.
- 10.3. Access via the short-link is read-only: the recipient can view the basket composition and price comparison but CANNOT modify the basket, place orders, make payments or access the User's Account.
- 10.4. The User may revoke a generated link at any time in the Account panel — from that moment, attempts to open the link return an access-denied message.
- 10.5. The Administrator may revoke the link automatically after the retention period elapses, when the Account is deleted, or in case of an abuse report.
9.6. Sharing a basket with another person: Only the User creates the link and only the User decides who receives it. The composition of a basket may reveal information about the health of the User or of the person the User is buying for; by passing on the link, the User shares that information with the chosen people and should therefore pass it on only to those to whom the User wishes to disclose it. The recipient of the link does not need to give consent in order to view the basket in the read-only mode described in point 10.3.
§11 User Obligations and Prohibitions
11.1. When using the Platform, the User undertakes to:
- Use the Service in accordance with applicable Polish and European law
- Comply with the provisions of these Terms
- Respect the rights of other Users and the Administrator
- Refrain from actions that may disrupt or damage the operation of the Platform
- Not use the Platform in a manner that infringes the interests of the Administrator or third parties
11.2. It is prohibited to:
- Copy, modify, distribute or use content of the Platform without consent
- Use automated tools for data collection (bots)
- Attempt unauthorised access to the Platform's systems or other Users' accounts
- Introduce unlawful, offensive or third-party-rights-infringing content into the Service
- Circumvent payment systems or security measures
- Share the account with other persons
- Create multiple accounts by one person
- Impersonate other persons or entities
- Use Platform data for commercial purposes without the Administrator's consent
11.3. In case of breach of this section, the Administrator has the right to immediately block or remove the User's Account without refund of paid amounts and to take legal action.
§12 Information Accuracy and Limitations
12.1. The Administrator makes every effort to ensure that the price and availability information presented in the Service is current and accurate. However:
- Prices in pharmacies may change without notice
- Medicine availability may change in real time
- Information is updated periodically (typically every 24 hours)
- Final prices and purchase terms are determined by the pharmacy where you make the purchase
- The Administrator is not liable for errors in prices provided by pharmacies
12.2. Always verify the final price and purchase conditions directly with the chosen pharmacy before completing your order.
12.3. The Administrator does not guarantee:
- Uninterrupted access to the Service (technical breaks and maintenance are possible)
- Error-free operation of the Platform
- Availability of all medicines in all pharmacies
- That the prices shown are always the lowest available on the market (there may be pharmacies not covered by the Service)
§13 Medical Disclaimer
Important information:
- CheaperForDrug does not provide medical advice
- The Platform does not replace a consultation with a doctor or pharmacist
- Before purchasing and using medicines, ALWAYS consult a medical professional
- Do not use medicines without prior consultation with a doctor
- Always read the package insert before use
- If in doubt about medicine use, contact a doctor or pharmacist
13.1. Information presented in the Service (medicine names, descriptions, indications) is derived from publicly available sources and is for informational purposes only.
13.2. The Administrator is not responsible for the consequences of using medicines purchased through pharmacies that the Platform directs to.
13.3. The Service does not compare prices of prescription medicines. The User can ask a pharmacy nearby about the availability of a prescription medicine.
§14 Limitation of Liability
14.1. The Administrator is liable solely for providing price comparison services and for passing Inquiries and pharmacies' answers within the Platform. The Administrator is not liable for:
- The quality, safety, efficacy or authenticity of medicines sold by pharmacies
- The fulfilment of orders by online pharmacies and the handing over of products by Brick-and-mortar Pharmacies
- Delivery delays or problems with orders placed at pharmacies
- Errors in information provided by pharmacies (prices, availability, descriptions)
- Side effects or health problems related to medicine use
- Financial losses arising from purchases made at pharmacies
- Losses arising from the inability to use the Platform (technical downtime, errors)
- Acts or omissions of online pharmacies and Brick-and-mortar Pharmacies
- Loss of data caused by force majeure or hacking attacks
14.2. The Platform is provided "as is" without any express or implied warranties, including warranties of fitness for a particular purpose.
14.3. The Administrator's liability to the User for non-performance or improper performance of the services agreement is limited to the amount of the fee paid by the User for the Paid Subscription (in the case of a Free Subscription - up to PLN 100).
14.3a. The monetary cap on liability referred to in clause 14.3 does not apply to Consumers or to natural persons concluding a contract with the Administrator directly related to their business activity where, based on the content of the contract, it does not have a professional character for that person (analogous to art. 38a of the Polish Consumer Rights Act). The Administrator is liable to such persons under the general rules of the Polish Civil Code.
14.4. The above limitations of liability do not apply to damages:
- Caused intentionally or through gross negligence
- To the person (life, health)
- Where limitation of liability is impermissible under mandatory law
14.5. In the case of Consumers, the limitations of liability apply only to the extent permitted by consumer-protection law.
§15 Liability for conformity of the digital service with the contract
Contracts for the supply of the Paid Subscription concluded with Consumers are subject to the provisions implementing Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the supply of digital content and digital services (implemented in Poland in Chapter 5b of the Consumer Rights Act, arts. 43k-43q).
15.1. The Administrator is liable for the conformity of the Paid Subscription with the contract throughout its duration.
15.2. The digital service is in conformity with the contract if, in particular, its description, kind, quantity, quality, completeness, functionality, compatibility and other characteristics specified in the contract correspond to the contract, and it is fit for the particular purpose for which the Consumer needs it.
15.3. In the event of non-conformity of the digital service with the contract, the Consumer may demand bringing it into conformity with the contract.
15.4. The Administrator may refuse to bring the digital service into conformity with the contract if this is impossible or would entail disproportionate costs.
15.5. Where the digital service is not in conformity with the contract, the Consumer may make a declaration to reduce the price or to terminate the contract, in particular where: (a) bringing it into conformity is impossible or would entail disproportionate costs; (b) the Administrator has not brought the service into conformity within a reasonable time; (c) the non-conformity persists despite attempts; (d) the non-conformity is so significant that it justifies termination without prior demand to bring it into conformity.
15.6. The Consumer may not terminate the contract if the non-conformity is minor. The non-conformity is presumed to be significant.
15.7. Any reduced price must remain in the same proportion to the contract price as the value of the non-conforming digital service to the value of the conforming digital service. The refund due to the Consumer as a result of exercising the right to price reduction is made no later than within 14 days of receipt of the Consumer's price-reduction declaration.
15.8. The Administrator is required to inform the Consumer of updates necessary to maintain the conformity of the digital service with the contract during the supply period, and to provide such updates.
15.9. Complaints related to non-conformity of the digital service with the contract are processed according to the procedure set out in §18 of these Terms.
§16 Intellectual Property
16.1. All content available on the Platform, including texts, graphics, logos, icons, photos, the user interface, source code, databases and data compilations, is the property of WEBET Sp. z o.o. or its licensors and is protected by Polish and international copyright law and industrial property law.
16.2. Trademarks, including the name "CheaperForDrug" and the Service's logo, are registered trademarks of the Administrator and are subject to legal protection.
16.3. It is not allowed to copy, reproduce, modify, publish, transmit, sell, distribute, decompile or otherwise use materials from the Platform without the prior written consent of the Administrator.
16.4. The User receives a limited, non-exclusive, non-transferable licence to use the Platform exclusively for personal, non-commercial purposes in accordance with these Terms.
16.5. Data on medicine prices is sourced from publicly available online pharmacy resources and is processed automatically by the Service. The Administrator respects pharmacies' copyrights and uses the data solely for the purpose of price comparison.
§17 Changes to the Service and Terms
17.1. The Administrator reserves the right to:
- Modify, extend or limit the functionality of the Service
- Temporarily suspend or permanently discontinue the Service
- Introduce technical breaks in access to the Platform (maintenance, updates)
- Add or remove features of the Platform
- Change the number of pharmacies included in comparisons
17.2. The Administrator may amend these Terms for important reasons:
- Change in law
- Change in the scope or manner of providing services
- Security reasons
- Introduction of new functionalities
17.3. The Administrator will inform Users about changes to the Terms:
- By sending information to the email address provided at registration
- By displaying a notice in the Service
- With at least 14 days' notice before the changes take effect
17.4. The amended Terms bind a User who has an Account if the User was notified of the change in the manner described in point 17.3 and did not terminate the agreement before the changes took effect. The agreement can be terminated at no cost by deleting the Account in Settings or by writing to biuro@webet.pl.
17.5. Termination of the agreement because of a change to the Terms takes effect on the day the User gives it, no later than the day the changes take effect. Until that day the previous version of the Terms applies. If the change significantly and negatively affects access to the Paid Subscription or its use, the Consumer may also terminate the agreement free of charge within 30 days of the change taking effect or of receiving information about it, if that happened later (art. 43q of the Polish Consumer Rights Act).
17.6. Users with an active Paid Subscription who terminate the agreement because of a change to the Terms are entitled to a proportional refund of the fee for the unused subscription period.

§21 Applicable Law and Jurisdiction
21.1. These Terms and any agreements concluded on their basis are governed by Polish law and shall be interpreted in accordance with it.
21.2. In matters not regulated by these Terms, the following apply:

21.4. For Consumers, court jurisdiction is determined under the provisions of the Polish Code of Civil Procedure (usually the court competent for the Consumer's place of residence) or the law of the User's country of residence where mandatory under EU law.
21.5. In the event of discrepancies between language versions of the Terms, the Polish version shall prevail.
§22 Final Provisions
22.1. These Terms enter into force on 17 November 2025. Version v3.7 applies from 19 October 2026 to all Users. We notified Users of this version by e-mail and by a notice in the Service at least 14 days before it enters into force. Question packs bought before version v3.5 entered into force are subject to section 7.3 as worded in version v3.4 until they expire.
22.2. The current version of the Terms is always available at: taniejpolek.pl/regulamin in a form that allows downloading, saving and printing.
22.3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
22.4. Failure by the Administrator to enforce any right arising from the Terms does not constitute a waiver of that right.
22.5. The Administrator may transfer rights and obligations under these Terms to a third party provided that the rights of Users are not impaired.
Terms change history:
- 19 October 2026 (v3.7) — added section 1.6: only persons who have reached the age of 18 may use the Service.
- 16 October 2026 (v3.6) — added § 8 (Inquiry to pharmacies nearby and pickup with a code) and the definitions of Brick-and-mortar Pharmacy, Inquiry and Pickup Code; the previous §§ 8–23 were renumbered §§ 9–24; §§ 3, 5, 6, 13, 14 and 19 were supplemented with brick-and-mortar pharmacies; internal references were corrected; the notice period for changes to the Terms was unified (at least 14 days).
- 6 October 2026 — correction: the Annual Subscription price, the AI question pack price and the currency of payment are stated in the currency of the User's market; the prices charged are unchanged.
- October 16, 2026 (v3.5) — Medicine Cabinet AI (§7): sending a question requires an Account; the Free Account has 2 questions in total instead of 5; Paid Subscription unchanged (50 questions per year); pack questions can be used only with an active Paid Subscription, and unused questions are refundable on request; questions that received no answer do not count towards the allowance. §6: description of the Free and Paid Subscription after the change in the split of features (one saved basket on the free plan; supply-end reminders, the basket price chart and the full ‘What got cheaper’ list in the Paid Subscription); ‘Supply & price’ instead of ‘When to buy’; the referral programme rules (6.10). §2.1: ‘medicines’ without the abbreviation. §16.4–16.5: an amended version of the Terms binds a User who has not terminated the agreement before the changes take effect. §18.4: consent to the processing of health data also covers messages to Medicine Cabinet AI, with a pointer to point 5 of the Privacy Policy.
- 25 September 2026 (v3.4) — Added: a description of the Premium features from points 5/6 (basket substitutes, ‘When to buy’, the full weekly deals list and email), the terms for Medicine Cabinet AI question packs (§7), and additional Paid Subscription cancellation rules for the Germany/Austria markets.
- 24 September 2026 (v3.3) — The annual Subscription renews automatically every 12 months at the regular price (a promotional code reduces only the price of the first period). Added: an email at least 7 days before each renewal, cancelling and resuming the renewal in the Account (My account → Plan & referrals) or by email, rules for a failed renewal payment (no grace period, resumption after a successful retry), the 30-day money-back guarantee also for renewal payments (a refund or withdrawal switches off the renewal), automatic Account creation for purchases without logging in, and the reasons and procedure for price changes. Removed the reference to the Stripe customer panel and the contradiction between the payment and termination provisions. Subscriptions bought earlier as a one-time payment do not renew automatically.
- July 3, 2026 (v3.2) — no change to the text of these Terms. The change to the Privacy Policy described at the time (AI processing and the AI model provider) was not published; it is introduced by the version of the Privacy Policy dated October 16, 2026.
- May 21, 2026 (v3.1) — correction of the incorrectly stated Annual Subscription price and clarification of the Free Subscription mechanics (1 free full comparison + threshold algorithm instead of the previously, incorrectly described percentage threshold). No functional changes to the service.
- 20 May 2026 — legal audit PHASE 3: introduction of §9 (Short-Links /c/<32hex> — read-only capability URLs), extension of §18 with a pointer to art. 9(2)(a) GDPR and to the consent window for health data, addition of the policy_version re-consent mechanism in §16.4 replacing tacit acceptance, removal of the email paywall.
- 14 May 2026 - legal audit Phase 2: addition of an exemption for Consumers and natural persons concluding non-professional contracts from the monetary liability cap (new clause 11.3a, analogous to art. 38a of the Polish Consumer Rights Act - removing the risk of an abusive clause); simplification of §5 (User Account) structure - all provisions placed under a single 5.1-5.7 numbering with sub-points (a)(b)(c)(d).
- 14 May 2026 - legal audit Phase 1: addition of §4 (Technical Requirements), §12 (Liability for digital service conformity, implementing Directive 2019/770) and Annex 1 (Model withdrawal form) with a downloadable PDF. All subsequent sections shifted by +2.
- 13 May 2026 - compliance audit update: removal of expired promotional prices, replacement of the silent acceptance clause with an active acceptance mechanism within 14 days, clarification of automatic renewal rules (email notification 7 days in advance, cancellation panel in account settings).
- 17 November 2025 - initial version of the Terms.
